1. Introduction
Welcome to the website of Martina Johannes Physiotherapist, trading as Move With Martina (referred to herein as “the Practice”, “we”, “us”, or “our”). By accessing this website, booking a consultation, or participating in our Myofascial Activated Posture (MAP) movement classes, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must cease use of this website and our services immediately.
2. Interpretation and Definitions
In these Terms and Conditions, unless the context dictates otherwise, the following terms shall have the specified meanings:
“User”, “you”, or “your” refers to any individual accessing this website, booking a service, or participating in a class.
“Patient” refers specifically to an individual receiving clinical physiotherapy services.
Client” refers specifically to an individual participating in MAP movement classes.
“Services” encompasses all clinical physiotherapy treatments, MAP movement classes, assessments, and any related advice provided by the Practice.
“Website” means the digital presence operated by the Practice, detailing our services, operating hours, and contact information.
3. Nature of Services and Medical Disclaimer
The Practice provides dual services: registered clinical physiotherapy and guided MAP movement classes. It is critical to understand the distinction between these offerings.
Website Information: The content provided on this website, including blog posts, descriptions of fascial release, and recovery stories, is for informational and educational purposes only. It does not constitute formal medical advice, diagnosis, or a treatment plan. You should never delay seeking professional medical attention because of something you have read on this website.
Clinical Physiotherapy: Physiotherapy services are provided by a registered healthcare professional governed by the Health Professions Council of South Africa (HPCSA). Treatment plans are individualised following an in-person assessment.
MAP Movement Classes: These classes are designed for functional movement, tension release, and general well-being. While they support recovery, they are not a substitute for targeted medical treatment for acute injuries.
4. Booking, Payment, and Cancellation Policy
To ensure the smooth operation of the Practice and to accommodate all patients and clients requiring attention, strict booking and cancellation protocols are enforced.
Appointments and Class Bookings: All sessions must be booked in advance. Walk-in appointments cannot be guaranteed.
Cancellations: We require a minimum of 24 hours’ notice for the cancellation or rescheduling of any physiotherapy appointment or MAP movement class. Failure to provide 24 hours’ notice will result in the full fee for the session being charged to your account.
Late Arrivals: If you arrive late for a scheduled session, the session will still end at the originally scheduled time to prevent delays for subsequent patients. The full fee for the session remains payable.
Payment Terms: Payment is due immediately upon the conclusion of the consultation or class, unless an alternative prior arrangement has been agreed upon in writing. We accept cash, card payments, and electronic funds transfers (EFT).
Medical Aid Claims: As a registered physiotherapy practice, our clinical services may be claimed from South African medical aid schemes. It remains your strict responsibility to ensure you have sufficient funds or appropriate coverage. If your medical aid scheme rejects a claim or short-pays the account, you remain fully liable for the outstanding balance.
5. Consent to Treatment and Assumption of Risk
Informed Consent: By proceeding with a physiotherapy consultation, you consent to physical assessment and treatment. You have the right to ask questions about your treatment plan, the techniques used, and any associated risks before proceeding.
Assumption of Risk in Classes: Participating in physical exercise, including MAP movement classes, carries an inherent risk of injury. By attending these classes, you confirm that you are physically capable of participating. You agree to disclose any pre-existing medical conditions, injuries, or surgeries to the instructor prior to the start of the class. You participate entirely at your own risk.
6. Protection of Personal Information (POPIA) and Medical Records
The Practice is fully committed to protecting your privacy and complying with the Protection of Personal Information Act 4 of 2013 (POPIA) and the National Health Act 61 of 2003.
Data Collection: We collect personal, contact, and medical information necessary to provide safe and effective healthcare and movement guidance.
Confidentiality: All medical records and personal details are kept strictly confidential. We will not share your clinical information with third parties (such as referring doctors or specialists) without your explicit verbal or written consent.
Data Retention: In accordance with South African healthcare regulations, patient records are retained for a minimum period of six years from the date of the last entry, or longer in the case of minors, before being securely destroyed.
Data Security: We implement reasonable technical and organisational measures to secure your personal data against unauthorised access, loss, or destruction.
